Use of Services

  For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise

• To impersonate or attempt to impersonate Gibson Beach Rentals, a Gibson Beach Rentals employee, another user, or any other person or entity

Property Reservations

If you make a reservation for a rental property through our Services, you agree to abide by the rental terms and policies set forth by Gibson Beach Rentals and the property owner or manager. You are responsible for ensuring that your rental information, including dates of stay, number of guests, and other information, is accurate and complete.                                

User Content

You may have the opportunity to submit content, such as reviews or comments, to our Services ("User Content"). You retain all rights in, and are solely responsible for, the User Content you submit. By submitting User Content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and our business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

Intellectual Property

Our Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Gibson Beach Rentals, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, distribute, sell, or lease any part of our Services, nor may you reverse engineer or attempt to extract the source code of our software.

Indemnification

You agree to defend, indemnify, and hold harmless Gibson Beach Rentals, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services.

Disclaimer of Warranties

Our Services are provided "as is" and "as available," without any warranties of any kind, 

express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Gibson Beach Rentals does not guarantee that the Services will be uninterrupted or error-free, nor does it make any representations or warranties about the accuracy or completeness of any content or information on the Services.

Limitation of Liability

In no event shall Gibson Beach Rentals, its affiliates, licensors, service providers, or its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, or assigns be liable for any indirect, consequential, punitive, special, or incidental damages arising out of or related to these Terms or your use of the Services, even if Gibson Beach Rentals has been advised of the possibility of such damages.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in Okaloosa County, Florida.

Termination

Gibson Beach Rentals may terminate or suspend your access to all or part of the Services, with or without notice, for any reason or no reason, including if you breach these Terms.

Changes to Terms of Use

Gibson Beach Rentals may update or revise these Terms from time to time, and any changes will be effective immediately upon posting. Your continued use of the Services after the posting of any revised Terms constitutes your acceptance of such revised Terms.
